STANDARD COMPETITION TERMS

1. Qualifying Persons

1.1 Lucky Draw Competition (‘Promoter’, ‘our(s)’) operates various competitions resulting in the allocation of prizes (‘Prize’ or ‘Prizes’)in accordance with these terms and conditions on the website luckydrawcompetition.co.uk(the ‘Website’)– (every such competition being denoted by ‘Competition’ or ‘Competitions’)

1.2 Competitions are for persons aged 16 or over who live in the Great Britain. Promoter’s employees or any person associated with the Promoter (through professional, family, or commercial association) are restricted from taking part in the Competition.

1.3 The Promoter reserves the right to close the account of a Customer at any time, if they feel the Customer is abusing the services, being abusive to other Customers or staff or they believe that it is not genuinely the Customer that is entering.

1.4 The Promoter reserves the right to refuse the entry of a Customer at the discretion of the Promoter.

2. Legal Undertaking

2.1 By taking part in a Competition the entrant (‘Entrant’, ‘you’, ‘your(s)’and/or ‘Customer’) will be deemed to have legal capacity to do so, you will have read, understood, and accepted these terms and conditions. You will also be bound by them and by any other requirements set out in any of the related promotional material of the promoter.

2.2 English Law will govern all the competitions and all disputes or matters associated with the Competition will be resolved and/or dealt with under English Law. The Courts of England shall have exclusive jurisdiction.

2.3 In the event that you take part in a Competition online via the Website, and by accepting these terms and conditions, you hereby agree that you are not breaching any laws in the country you reside with respect to the legality of taking part in our Competitions. The Promoter is not responsible for any Entrant unlawfully participating in any of our Competitions. In case of any doubt, you should leave the Website immediately and check with the appropriate authorities in your country.

3. Competition Entry

3.1 Competitions may be entered through the Website. More than one Competition may be operated simultaneously by the Promoter and every Competition will have a particular Prize.

3.2 Pricing and availability of Competitions is at the discretion of the Promoter and will be specified at the point of sale on the Website. There is no obligation to pay to enter any Competition, as every Competition comes with a free entry route. The presence of a free entry route to enter every Competition means that the Competition does not fall within the definition of a lottery under the Gambling Act 2005 and can be operated legally in Great Britain without any need for a license.

3.3 To enter a Competition, you will need to sign up for an account. You can sign up for an account online. To sign up for an account online you will be requested to provide an email address or sign in through a social media account, for instance, Gmail, Twitter, or Facebook(‘Social Media Account’).

3.4 When playing a Competition online through the Website, the on-screen instructions must be followed to: (a) choose the Competition you want to enter and when you are prepared to purchase your ticket(s) to the Competition (‘Tickets’), provide your payment and contact details. You will need to carefully check your details and tick the declaration. This will confirm that you have read and understood the terms and conditions of the Competition; (b) once you have bought your Tickets, register to play the relevant Competition. When your payment has cleared, we will contact you by email to confirm your entry. Remember that when entering by post and/or online you cannot enter the Competition until we confirm your entry. This can be confirmed in your account when you log in (and any such entry is denoted herein as an ‘Entry’ or ‘Entries’).

3.5 The Promoter have the right to disqualify or refuse any incomplete Entry if it has justifiable grounds for believing that an Entrant has contravened one or more of these terms and conditions.

3.7 Every Entry become the property of the promoter and will not be returned to the extent permitted by applicable law.

3.8 The Entrant can participate in each of the Competition up to 10 times maximum.

3.9 Every Competition closes after the last number is taken, after this point, no more Entries will be accepted.

3.10 Every Entrant (including free entrants) must sign up for an account before entering and provide an email address to go ahead with the Competition.

3.11 Ticket colors meaning guide: Red – sold, Black -available to buy, Green- your selection, Yellow- in your cart, Brown- pending someone else. Tickets in your cart will be reserved for 10 minutes before auto cleared.

4. Promotion Periods

4.1 Every Competition will run for a particular period. Please see every Competition for dates along with start and end times (‘Promotion Period(s)’).

5. Competition Judgement

5.1 The winner(s) (‘Winner(s)’) of each Competition will be chosen by https://wpraffle.com/ or randompicker.com. The result will be streamed live on Facebook and/or YouTube (or other internet channel as the Promoter chooses).

5.2 Due to the selection’s nature, there will be just one Winner per Competition, unless stated otherwise by the Promoter.

5.3 The Promoter will attempt to contact Winners of Competitions (denoted herein as ‘Winner(s)’) using the email address and telephone number provided at the time of Entry and held securely in our database. The Entrants obliged to ensure that these details are complete, up to date, and accurate. If, for any reason, these details are submitted, in putted, taken down, and/or recorded incorrectly by you in any way, the Promoter will not be held accountable for any consequences, whatever nature and howsoever arising. Therefore, entrants must carefully check their contact details to ensure that they have been correctly recorded.

5.4 If the Promoter is not able to contact a Winner within 5 working days of the end of a Competition, or the Winner is disqualified as a result of not complying with or contravening any of these terms and conditions and/or the Winner is not able to confirm acceptance of the Prize, the Winner hereby agrees that it will automatically, irrevocably, and immediately, forfeit the Prize and the Prize will remain in the ownership and possession of the Promoter.

5.5 If the Promoter prematurely closes a Competition, the Winner will be selected from all eligible and valid Entries received by the Promoter before the date of closure, except that the Promoter, at its sole discretion, reserves the right to close a Competition prematurely without selecting a Winner. In cases such as these, the Promoter will give every Entrant a game credit to allow them to replay equivalent Tickets in the next Competition.

5.6 Entrants specifically consenting to marketing communications will be entered onto the database of the promoter for conveying information as to the status of their Competition, along with any future Competitions or promotions provided by the Promoter.

5.7 The Promoter, at its sole discretion, has the right to extend the closing date of any Competition. The promoter can extend the time of every Competition up to 4 times. If the Competition is unable to be sold out after the 4th time extension, then the Prize awarded will be as follows: 60% of the value of paid Entries to the Competition. Only the Competition Entrants (with free Entries being inclusive) will be entered into this draw.

6. Winner’s Details

6.1 The Winner will be asked to show proof of identification on Prize delivery. Any failure to comply with this requirement may result in the Promoter retaining the Prize and the Winner being disqualified.

6.2 All Winners will be requested for their consent by the Promoter to pose for photographs and videos and/or provide photographs. They should also have their personal details such as details of any Prize won by them) contained within the marketing material. If a Winner agrees to the above, the foregoing videos, photographs, and marketing material may be used in future public relations and marketing by the Promoter in connection with the Competition and in identifying them as a Winner.

6.3 Following verification and receipt of the details demanded above by the Promoter and provided that the Winner has adhered to these terms and conditions, the Winners will be contacted to make arrangements for Prize delivery.

7. Competition Prizes

7.1 The Prizes are determined, chosen by some and/or all of the company directors and are owned by the Promoter from the date of live Competition on the Website to the date that the Prize is given to the winner. Details of every Prize can be found on the Website on the Competition pages. Lucky Draw Competition cannot be held accountable for the Prize awarded after delivery has been done. Once the Prize is given to the Winner, the Prize is not insured by the Promoter. No insurance includes the Prizes and the Promoter cannot be held accountable for the Prize once it has been given to the Winner.

7.2 Prize delivery to the home address of Winner in Great Britain is free of any charge. The Promoter may charge and/or has a right to the Winner delivery fees if they want the Prize to be delivered somewhere outside Great Britain.

7.3 All Entrant expenses to gather the Prize are the responsibility of the Winner only.

7.4 The Winner hereby agrees that every Prize is subject to and is conditional on the terms and conditions of the supplier, manufacturer, Prize provider, Promoter and/or anyone that is engaged in the delivery or provision of the Prize to the Winner.

7.5 Every Prize must be accepted as awarded and is non-convertible or transferable to other substitutes. It cannot be used in combination with any other discounts, offers, or vouchers, including without limitation any offers or vouchers of the Promoter or other third parties and/or Prize suppliers.

8. Storage

The Promoter can store the selected Prize free of charge for a maximum of 30 days after informing the Winner, at the end of which time the Prize will be sent to the Winner. If the Prize needs to be kept by the Promoter for more than 30 days then this shall be at the full cost of the Winner where such cost will need to be paid by the Winner to the Promoter before the Winner accepts the Prize.

9. Winners’ Personal Data

9.1 Subject to the consent of the winner, the Winner may be requested to have their video and photo taken by the Promoter for promotional purposes like Marketing and Public Relations.

9.2 When entering a Competition, the Entrant will be requested to consent to use of their photograph, address, name and/or or other likeness, along with your appearance at publicity events without any extra compensation (except for rational travel expenses that are approved in advance and in writing by the Promoter) and as required by the Promoter.

10. Limits of Liability

10.1 The Promoter gives or makes no warranties and/or representations and/or assurances of whatever nature and howsoever arising (and whether in writing or otherwise) as to the quality, suitability and/or fitness for any particular purpose of any of the goods or services advertised, offered and/or provided as Prizes. Except for liability for death or personal injury caused by the negligence of the Promoter and/or for any fraudulent misrepresentations and/or for any events and/or circumstances to the extent that they cannot be excluded or limited by law. The Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the Prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.

10.2 The total maximum aggregate liability of the Promoter to each Winner shall be limited to the total value of each Prize that has been won by the relevant Winner.

10.3 The total maximum aggregate liability of the Promoter to you shall (if you are not a Winner) be limited to the amount that you have paid to enter Competitions in the first 12 months of you playing any Competition.

10.4 Nothing in these terms and conditions shall prevent you making claims to the extent that you are exercising your statutory rights.

11. Electronic Communications: No responsibility will be accepted by the Promoter for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorized human act, including any errors or mistakes. The Promoter shall use its rational endeavors to award the Prize for a Competition to the right Entrant. If due to reasons of software, hardware, human error or any computer-related failure, the Prize is not awarded correctly, the Promoter has the right to reclaim the Prize and award it to the right Entrant, without admission of liability at its sole discretion. The Entrant that has been wrongly awarded the Prize will immediately, at the cost and expense of the Entrant, pay the Promoter for that Prize (at the option of the Promoter) and/or return it to the Promoter. The Promoter cannot be held accountable for any consequential and/or other and/or economic loss sustained or suffered to any persons to whom an award has been incorrectly given, and no compensation shall be due to such persons. The Promoter shall use its reasonable endeavors to ensure that the Website(s) and software used to operate its Competitions performs accurately and correctly and across the latest versions of internet, mobile and tablet browsers. To avoid any doubt, only the Ticket recorded in our systems, howsoever calculated or displayed, shall be entered into the relevant Competition and the Promoter shall not be held accountable for any Competition Entries that surface as a consequence of software malfunction or other event.

12. Data Protection Notice: Any personal data that you provide to the Promoter or authorize the Promoter to acquire from a third party, for instance, a credit card firm, will be used by the Promoter to fulfil Prizes and administer the Competition where applicable. To use, record, and process your personal data the Promoter may reveal it to (i) any credit card firm whose name you provide; (ii) any person to whom the Promoter advises to transfer any of the rights and/or responsibilities of the promoter under any agreement the Promoter may have with you; (iii) any person to whom the Promoter advises to transfer its business or any part of it; (iv) adhere to any regulatory or legal requirement of the Promoter in any country; and (v) prosecute, detect, or prevent fraud and other crimes. To record, use, process, and disclose your personal data, the Promoter may need to transfer such information outside the UK, in which event the Promoter is held accountable for ensuring that your personal data continues to be adequately protected during the course of such transfer.

13. Free entry method: To enter any competition for free, you must first create an account and then send your name, address, date of birth, e- mail address and contact telephone number on a postcard to the Promoter. Free entries must be posted to: info@luckydrawcompetition.co.uk and must reach by the closing date of the Competition. First or second-class postage must be paid. Postal Entries are restricted to a single Entry to each Competition per postcard. The Entrant must lay down which Competition they wish to enter. For Competitions a random number/s will be allocated to each free entry by the Promoter. Every free Entry will be treated exactly the same way as a paid Entry. Where applicable, the terms and conditions of the Competition also apply to free Entries. Every free entry is processed on Monday of each week.

14. Validation

14.1 The Promoter has the right not make or give a Prize until it is confirmed that (a) the Winner is not in breach of these terms and conditions and/or has a validly registered Website account, (b) all and/or any amounts owing or due by you to the Promoter have been fully paid, (c) the identity of the Winner and his/her entitlement to receive the Prize has been established to the satisfaction of the promoter (specifically, the Promoter has the right to demand documentary proof of identity and not to make or give a Prize until satisfied appropriate proof of identity has been given), and (d) the Promoter may require proof of age to be produced before making or giving a Prize. Prizes will not be made or given to Winners found to be under16 years of age.

14.2 Without prejudice to rule 14.1 mentioned above, the Promoter has the right not to give or make a Prize if it reasonably suspects the occurrence of fraud in relation to a Competition.

14.3 The Promoter may, at its sole and absolute discretion, make or give a Prize to a person whom it is satisfied is the duly authorized representative of the Winner acting under a lawfully executed power of attorney or other equivalent authorization.

15. Your account

15.1 You must keep your account password safe and secret at all times and take steps to prevent it being used without your permission. You must (a) memorize your password and never share it with anyone, (b) never write down your password or record it in a manner that can be understood by someone else, (c) abolish any communications from the Promoter with respect to your password as soon as you are done reading them, (d) refrain from using a password that is easy to guess, (e) ensure that, apart from you, none else uses your account while you and/or your devices are logged on to the Website, (f) exit or log off from your account when not using it, and (g) keep your access information and password a secret,

15.2 Your log in details and password are personal to you and should not be shared with anyone else and/or used to offer shared access, for example, over a network. You must maintain good internet security and use a password which is unique to your account.

15.3 If you believe, suspect or know that anyone apart from you has used your account and/or given any instruction in relation to it without your permission, or if you believe, suspect or know someone else knows your password, you must contact the Promoter immediately.

15.4 If you forget your password, you can reset it by following the instructions on the Website (as long as you can provide the relevant security information requested or required by the Promoter)

15.5 The Promoter shall not be responsible and/or liable for any and/or all consequences arising out of and/or relating to any and/or all breaches of this rule 15.5 by you. Additionally, the Promoter shall not in any event be liable and/or responsible for any inactions and/or actions that you may take and/or consequences that you may suffer and/or incur as a result of using and/or in connection with the Website.

16 Changes

16.1 We may revise our terms and conditions from time to time and will post the most current version on the Website as soon as possible after the revised terms and conditions become effective. Please check this page every so often to ensure you understand the terms and conditions that apply at that time. By continuing to access and/or use the Website after the revisions come into effect, you agree to be bound by the revised terms and conditions. We may also update and change the Website and Competitions draws from time to time to, amongst other things, reflect changes to our offering, Website, IT systems and/or our users’ needs and/or feedback.

17. Unauthorized use and expiry of your debit card

17.1 If you inform your nominated bank or building society that your debit card has been used without your permission in relation to a Competition and your nominated bank or building society requests the Promoter to return the appropriate amount to your nominated building society or bank account, the Promoter may seize your account and request you to contact the Promoter. The Promoter has no responsibility and will have no liability for any chargebacks.

17.2 If your debit card is nearing expiration, the Promoter will use adequate efforts to return the funds in your account before midnight on the day it expires. If it is unable to do so, the Promoter will use adequate efforts to alert you of this and you should, under these conditions, contact the Promoter to arrange another suitable way for the Promoter to return the funds back to you.

18. Use of the Website

18.1 You hereby agree that (a) the Website and the Competitions are for your own personal, non-commercial use, and (b) you are only allowed to use your account and the Website and enter Competitions through your account, as mentioned in these terms and conditions.

18.2 You also hereby agree that you will use your account only, enter Competitions and use and/or access the Website in a lawful and appropriate manner. You will not (a) transmit, access, and/or receive any content which is defamatory, offensive, menacing, racist, threatening, pornographic, obscene, in breach of any intellectual property right (including, without limit, copyright), in breach of confidence, and/or otherwise unlawful and/or objectionable, (b) recklessly and/or knowingly communicate any content (including, without limit, viruses) through the Promoter’s software and IT systems and/or Website which will cause, or be likely to cause, (i) harm and/or detriment, in any degree, to the Website, the software of the promoter and IT systems operated and/or owned by the Promoter and/or others, and/or (ii) damage to and/or loss of data, (c) make excessive traffic demands on, hack into, or cause any impairment of the functions of any computer system, forward or deliver chain letters, “junk mail” of any kind, contests, surveys, pyramid schemes or otherwise participate in any behavior intended to refrain others from playing or entering in Competitions, entering Elite Club draws and/or using the Website and/or any other website, and/or which is otherwise likely to damage the reputation and/or business of the Promoter and/or of any third party, and/or (d) authorize or permit anyone to do 21.2(a) – (c).

18.3 You hereby agree to indemnify the Promoter against all and/or any expenses, damages, losses, and which the Promoter may incur and/or suffer in relation to and/or out of any legal proceeding, claim, and/or demand made by any third party arising out of and/or due to your negligent, wrongful, and/or unlawful access and/or use of your account, the Website and/or the Promoter’s software and/or IT systems, and/or breach by you of these terms and conditions.

18.4 There is no guarantee that the Website will display correctly on all devices it can be viewed on.

18.5 The Promoter is the owner or licensee of all the copyright, trademarks and other intellectual property rights in, to and in respect of the Competitions, the Elite Club, and the Website, and you will not obtain any rights in any of these.

18.6 Proprietary designations, source identifiers, trade names, logos, service marks, and/or trademarks (“Trademarks”) of the Promoter used on and/or in connection with the Website and the Competitions are trademarks of the Promoter. Trademarks of third parties in connection and/or used on with the Website and the Competitions are used for the purposes of identification only and may be the property of their respective owners.

18.7 You must not (a) transmit, disclose, copy, and/or otherwise make available and/or change or remove any material available on the Website, (b) decompile or reverse engineer (whether in whole or in part) any software used in connection with the Website and/or the provision of the Competitions (except to the extent expressly permitted by applicable law) and/or (c) remove, obscure and/or change any copyright, trade mark or other intellectual property right notices in any material obtained from the Website and/or as a result of playing the Competitions.

18.8 You hereby agree that playing Competitions (as well using and/or accessing your account) whilst located in any jurisdiction besides the Great Britain is strictly prohibited.

19. Discretion: The exercise by the Promoter of any discretion offered for in these terms and conditions will be final and binding.

20. General

20.1 If the Promoter delays and/or fails to enforce a provision of the terms and conditions, this delay and/or failure is not a waiver of the Promoter’s right to do so later on.

20.2 If any, or part of a provision, of these terms and conditions is decided by a court of competent jurisdiction to be unenforceable and/or void, that decision will just influence the specific provision, or part of the provision, and will not, in itself, make the other provisions unenforceable or void.

20.3 You may not transfer or assign (in part or in whole) your obligations and/or rights within these terms and conditions. Any breach of this rule 20.3 may result in your account and/or the provision of the Competition and/or access to the Website being terminated or suspended instantly by the Promoter. The Promoter may assign or otherwise their obligations and/or rights under these terms and conditions in part or in whole to any third party at its absolute and sole discretion and without your consent. The Promoter may also dispense these terms and conditions in their entirety, without your consent, to its successor in interest in connection with a merger, reorganization, or sale of every or substantially all equity or assets. These terms and conditions shall bind and inure to the benefit of the promoter, its permitted assigns and successors.

20.4 These terms and conditions make up the entire agreement between the Promoter and you regarding the subject matter of these terms conditions and replace and supersede any other contemporaneous and/or prior agreements, and/or terms and conditions relevant to the subject matter of these terms and conditions.

20.5 A person, who is not a party to these terms and conditions, has no rights under the Contracts (Rights of Third Parties) Act 1999 (as re-enacted or amended from time to time, and any subordinate legislation made under that act) or otherwise to impose any provision of these terms and conditions.

20.6 The Promoter cannot be held accountable for any delay or failure to perform any obligation under these terms and conditions where the delay or failure results from any cause beyond its reasonable control, including acts of God, labor clashes or other industrial disturbances, power or electrical outages, utilities or other network/telecommunication storms, earthquake, failures, or other elements of nature, riots, embargoes, blockages, orders or acts of government, acts of terrorism, or war.

20.7 The Website may include hyperlinks to websites ran by parties other than us. Such hyperlinks are given for your convenience and reference only. We do not control these websites and cannot be held accountable for their privacy and/or content or other practices of these websites. It is up to you to take necessary precautions to ensure that whatever software you download and/or links they select from such websites are virus-free. Our insertion of hyperlinks to such websites does not infer any endorsement of the material on such sponsorship, association, websites, and/or partnership with their operators. You must not make a text hyperlink to the Website without our prior written consent.

20.8 Every player can enter a single competition for a number of 10 times at max.
